Receiving an Eviction
Warrant
We have seen many people receive an eviction warrant
who have generally not taken their mortgage seriously that do not
believe their home will ever be repossessed. After suspending a
repossession order it is important that you keep to the order to
the penny and to the day. If a court tells you to pay £100
extra on the 1st day of the month and you can only afford £90
one month and don't pay this until the 5th of the month the lender
has the right to as the court to issue an eviction warrant without
the need for a further hearing.
Whatever stage you are at if you are going to fall
into arrears or are in arrears with your mortgage the last stage
is eviction itself and the only way to avoid this is by sticking
to the suspended repossession order terms. If you are going to default
on this it is important that you speak to your lender and see if
they can be at all lenient with you. This will likely depend on
how great a risk they think their security is under. If you have
lots of equity stress this to the lender, if you are shortly going
to complete on a secured loan to clear the arrears show the lender
evidence.
You may have no alternative but to sell your home
or maybe completely refinance, either way it is best that you do
this as soon as possible so that you have as much time as possible
before receiving the eviction warrant and then actually being evicted.

Your home is likely to be your biggest asset and
it is best to seek as much advice as possible, you can approach
the citizens advice bureau free of charge, you could speak to a
lawyer and you can also speak to a mortgage broker to see if a secured
loan or new mortgage is an option to stop an eviction.
